Introduction

Welcome to Coastal Board Co. These Terms of Service ("Terms") govern your access to and use of our website, products, and services. By accessing or using our services, you agree to be bound by these Terms. If you disagree with any part of these terms, you may not access the service.

Use of Services

Our services are intended for personal, non-commercial use. You may not modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any information, products, or services obtained from our services without our prior written permission.

Account Creation

Some portions of our services may require you to create an account. You are responsible for maintaining the confidentiality of your account information, including your password, and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use of your account.

Age Restrictions

Our services are intended for users who are 18 years of age or older. By using our services, you represent and warrant that you are at least 18 years old. If you are under 18 years old, you may only use our services under the supervision of a parent or legal guardian.

Product Purchases and Orders

When you place an order through our website, you are making an offer to purchase products. We reserve the right to refuse or cancel any order for any reason, including but not limited to product availability, errors in product or pricing information, or problems with payment processing.

Pricing and Payment

All prices are listed in Australian Dollars (AUD) and are subject to change without notice. We strive to provide accurate product and pricing information, but errors may occur. If we discover an error in the price of products you have ordered, we will inform you as soon as possible and give you the option of reconfirming your order at the correct price or canceling it.

Shipping and Delivery

Shipping times and costs may vary depending on your location and the products ordered. We are not responsible for delays in delivery that are beyond our control. Risk of loss and title for items purchased pass to you upon delivery of the items to the carrier.

Product Warranties and Returns

We stand behind the quality of our products. All custom and stock surfboards and skateboards come with a limited warranty against manufacturing defects for a period of 90 days from the date of purchase. This warranty does not cover damage resulting from misuse, accidents, or normal wear and tear.

Return Policy

If you are not satisfied with your purchase, you may return unused, undamaged items within 14 days of receipt for a full refund of the purchase price (excluding shipping costs). Custom orders are non-refundable but may be eligible for store credit or exchange at our discretion.

Product Information

We make every effort to accurately display the colors and features of our products. However, we cannot guarantee that your computer monitor's display of any color will be accurate. Product specifications may change without notice.

Intellectual Property

All content included on our website, such as text, graphics, logos, images, audio clips, digital downloads, and data compilations, is the property of Coastal Board Co. or its content suppliers and is protected by international copyright laws. The compilation of all content on this site is the exclusive property of Coastal Board Co. and is protected by international copyright laws.

Trademarks

Our trademarks and trade dress may not be used in connection with any product or service that is not ours, in any manner that is likely to cause confusion among customers, or in any manner that disparages or discredits us.

Limitation of Liability

In no event shall Coastal Board Co., its officers, directors, employees, or agents, be liable to you for any direct, indirect, incidental, special, punitive, or consequential damages whatsoever resulting from any (i) errors, mistakes, or inaccuracies of content, (ii) personal injury or property damage, of any nature whatsoever, resulting from your access to and use of our services, (iii) any unauthorized access to or use of our secure servers and/or any and all personal information and/or financial information stored therein, (iv) any interruption or cessation of transmission to or from our services, (v) any bugs, viruses, trojan horses, or the like, which may be transmitted to or through our services by any third party, and/or (vi) any errors or omissions in any content or for any loss or damage of any kind incurred as a result of your use of any content posted, emailed, transmitted, or otherwise made available via the services, whether based on warranty, contract, tort, or any other legal theory, and whether or not the company is advised of the possibility of such damages.

Indemnification

You agree to defend, indemnify, and hold harmless Coastal Board Co., its officers, directors, employees, and agents, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees) arising from: (i) your use of and access to our services; (ii) your violation of any term of these Terms; (iii) your violation of any third party right, including without limitation any copyright, property, or privacy right; or (iv) any claim that your content caused damage to a third party. This defense and indemnification obligation will survive these Terms and your use of our services.

Governing Law

These Terms shall be governed and construed in accordance with the laws of New South Wales, Australia, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
